The information we hold about you comes from the way you engage with us (phone, online, email, sms). Your information may also come from interactions with us through social media and from 3rd parties such as credit reference and fraud prevention agencies.

The information we hold will include, but is not limited to the following:

  • Financial information e.g. forms of income, employment position, expenditures
  • Details disclosed by you with your explicit permission e.g. health conditions, disability accessibility disclosures, mental capacity disclosures.

If you provide us with personal information regarding other individuals which will be used by us to provide you with a service, then you must have their permission to disclose their information, or confirm that you have permission to provide us with their information.

You may need to complete a Subject Access Request which has an administration fee of £10 to access your data. Before submitting a request, we advise you to contact us. We may be able to provide you with specific data free of charge.

The information we collate about you is used to develop improvements to the products and services we offer. This also includes the creation of new products tailored to our customer’s needs.

We will also use your information for security, identification and verification needs when you contact us, as well as to aid with training and monitoring purposes. We will use the information you provide to:

  • Carry out regulatory checks and meet the obligations that come with being a regulated business.

All information provided by you can be viewed by employees of Pogo Loans, the trading name of Fire Capital Ltd.

All phone calls between yourself and Pogo Loans are recorded and monitored for training purposes. We may also monitor or record communications between you and us such as emails, letters, social media and instant messaging.

We may attempt to contact you via:

  • Telephone via any number disclosed to us
  • Text message
  • Email
  • Social media
  • Other digital methods

Contact may include, but is not limited to:

  • Messages regarding your account status
  • Messages regarding a change to your agreement
  • Messages that are required to be sent in line with relevant legal and regulatory requirements
  • Marketing messages to make you aware of offers, promotions, products and services. You can opt out of these messages at any time

Key written information will be sent to the email address provided by you for contact. This includes updates on your account and legal notices.

As part of our commitment to the Competition and Market Authority’s review into the Payday Loan industry, we will supply you with statements regarding your borrowing each time you take out a loan with us. All statements will be issued via email.

If you would prefer us to contact you using a specific contact method, please make us aware and we will, when possible, attempt to contact you using the specified method.

As a responsible firm we will keep your information confidential, however we may from time to time share your information in the following events:

  • If we have a duty to disclose your information
  • If we require your information for the management of your accounts
  • If we are required to disclose your information for legal or regulatory reasons
  • For legitimate business purposes

We may share your information with:

  • Other company’s owner by Fire Capital Ltd, trading as Pogo Loans within the United Kingdom, Isle of Man and Channel Islands.
  • Our service providers (and their sub-contractors). For example, this may include our I.T system provider.
  • Anyone to whom we are entitled to transfer our rights and duties under your loan agreement, for example, in the event of your loan being placed with a 3rd party we would be required to pass on your information.
  • Nominated 3rd parties for the gathering of customer feedback.
  • Payment processing service providers and other firms that help us process payments made from or to Pogo Loans.
  • Any individual assigned the right to discuss your account on your behalf, such as a lawyer, friend or family member with power of attorney over your financial arrangement.
  • UK regulators and authorities.
  • Fraud prevention agencies. We will always tell fraud prevention agencies of any attempt to provide us with false or fraudulent information. This will allow other organisations, such as the police and law enforcement agencies to access your information in an attempt to prevent and detect fraud, money laundering, financial crime or any other type of crime.
  • Credit reference agencies.

Should we ever need to share your information with an organisation in another country, we will ensure they agree to apply the relevant and equivalent levels of protection set out in the UK Data Protection Act, in line with the UK regulator the Information Commissioners Office.

Our site may, from time to time, contain links to and from the websites of our partners, marketers and affiliates. If you follow a link to any of these websites, please be aware that they will have their own privacy policies that state how they will use your personal data. We do not accept any responsibility or liability for these companies’ policies. It is your responsibility to check these policies before you submit any personal data to these websites.

We may disclose the personal information you disclose to us with other companies for the purpose of marketing. As a responsible firm, we would never offer a customer credit without first conducting credit reference and fraud protection checks. To do this we are required to provide information about you to the agencies to ensure we receive the correct file. Credit reference agencies may use your data for a number of purposes such as statistical reviews and updating your credit file.

All credit reference agencies keep a record of any requests for information (credit reference checks) required by us. These requests will leave a footprint that is visible for other organisations to see. These footprints may influence the decision of other lenders and could affect your ability to obtain credit.

Examples of times when information is shared between us, credit and fraud prevention agencies include:

  • A request for Pogo Loans to review an application submitted by you, resulting in a credit assessment being conducted.
  • Checking that the information provided by you during an application is correct.
  • To help us understand your current financial situations by sharing and receiving information. This will include information regarding accounts with Pogo Loans and other firms using the credit reference agency. The information provided may include the amount borrowed, your repayment history and any payment arrangements made outside of your contractual payments.
  • For the purposes of managing credit related accounts.

We reserve the right to conduct a credit search when:

  • You apply for a new account.
  • We discuss, amend or review a payment arrangement or offer of repayment, either as a temporary or long term alternative to your contractual payments, in the event of financial hardship.
  • In the event of a claim of fraud, identity theft or money laundering being made against one of your accounts.
  • In an event where it is in your best interest to request new information to effectively manage your account.

When performing a credit reference check information may be provided to us regarding people who you are associated with. This could be a partner or member of your household. This is likely to happen when:

  • In the event of having or applying for a joint application.
  • You declare to us that you have a financial association with another person.

Any association you have with another individual may be taken into account by us should you or the other individual choose to apply with us.

If you have a medical condition that may affect your ability to manage your account with us, it is important that you make us aware to ensure we can aid you in managing your account and enable us to treat you fairly.

We would like to hold this information on our records as it will be of benefit to the running of your account. It will enable us to be immediately aware of your condition when contacting you and save you from having to tell us about your medical circumstances each time we make contact.

This information will be made available to employees of Pogo Loans, the trading name of Fire Capital Ltd. for the purposes of discussing and managing your account only..

We may need to pass your information on to recognised partners or third parties should the need arise. We would only do this to ensure that we or the third party can continue to manage your account fairly. For example, should the debt ever be reassigned to another provider, we will make the new debt owner aware of any condition to aid their understanding of your current circumstances.

The medical data collected will be treated as ‘sensitive personal information’ in line with the Data Protection Act. Any information we collect, use, retain, or dispose of will be treated fairly and legally. The information provided will be updated accordingly as we gain more knowledge and understand of your condition.

Should your condition improve and/or details of your condition become irrelevant to the running of your account then we will delete this information.

We will only store information regarding your medical condition with your consent.
